# What the record concludes

Every conclusion below is drawn from artifacts already documented in `MASTER-EVIDENCE.md`. Nothing new is invented. Where a conclusion rests on Eyal's testimony rather than a document, it is labeled testimony and weighted accordingly.

## 1. Communication intensity

**Verdict: Boundless treated Eyal as core operating cadence, not as a vendor.**

Grounding:
- 52 unique Boundless calendar events June 2024 → Aug 27, 2026 with Eyal on the invite.
- Near-weekly Thursday VTCs Nov 2025 → Aug 2026 on the Boundless Zoom bridge (boundless-health.zoom.us/j/88550823977). Vendors do not sit on the standing weekly.
- Two Ibiza working weekends at George's private house: Oct 21-22, 2025 (presentation + working) and June 26-29, 2026 (four days, fifteen-plus working sessions).
- The June 12, 2026 Ibiza 2 agenda names Eyal in the eight-person room and gives him co-lead billing on two of the working sessions ("The App: Vision & Experience" with Allan; "The Sensory Whole" with Mathieu).
- Rosie Dent, the EA shared between Katya and George, has been running Eyal's scheduling, travel, and logistics since Sept 30, 2025 [GM sweep, 14+ instances]. Vendors do not get the founders' EA.
- Aug 15 dev call missed by Eyal is the only missed call across the entire runway.

Weight: Very high. Calendar and email evidence, not testimony.

## 2. Trust level

**Verdict: Trusted with founder-tier material and access, on the record and in writing.**

Grounding:
- Sept 17, 2025 [GM-20250917-0734]: George, writing from Kyoto, tells Eyal the mandate for the whole engagement in his own words: "the empathic technology platform is especially interesting." Founders do not put mandates in writing to a vendor.
- GitHub `empathic-art` repo has Bob Dougherty (Soundtrip) and Jacob Birk-Fandel (Boundless) as push collaborators. Boundless engineering embedded inside Eyal's repo. [REPO:empathic-art]
- Manifesto and VERA framework shared into the "Emotional AI Due Diligence" thread with Bob Nov 2-12, 2025 [GM-20251102 → GM-20251112]. Bob replies with detailed technical feedback the same week — Boundless treats Eyal's IP as substrate the engineering team is expected to build on.
- Aug 6, 2026 [GM-20260806-0007]: George shares the full Claude memo unredacted "in the interest of full transparency, the way I always work." Founders do not send the private strategic memo to someone outside the trust circle.
- Testimony: Allan asked Eyal's permission to use the Empathic Art manifesto in a California West Coast university engagement [EG:university-manifesto]. Permission-asking is a trust marker.

Weight: High. Four artifacts, one testimony.

## 3. How much they saw Eyal as important

**Verdict: Positioned as core to the app on the record.**

Grounding:
- Ibiza 2 agenda [GM-20260612-1505] lists Eyal in the eight-person room alongside George, Allan, Mathieu, Suuvi, Laura, Sian, Will. Eyal is on the same billing line as the internal team.
- **Eyal is named 7 times in the agenda body.** He leads or co-leads 3 of 11 working sessions, tied with Allan for the most session leadership after George.
- Eyal-led sessions are the technical spine of the weekend: **The App: Vision & Experience** (Fri, Allan + Eyal), **The Sensory Whole** (Sun, Mathieu + Eyal + Chris TBC), **App Development Plan v1 and v2** (Sun, Eyal + Bob + Allan). These are the three sessions that decide what the product is, how the art integrates with sound and voice, and how the September launch gets built.
- Bob's session "The App: Updates" is described in the agenda as "Broad run through current state of app for Eyal's alignment." The engineering session is briefing Eyal, not the other way around.
- No other artist or creative-technology contributor appears anywhere on the roster or the agenda.
- Aug 12, 2026 [DOC:DRAFT-Boundless-App-User-Narrative-v1.8.docx]: Allan's official app-narrative draft cites "Eyal's 19-page Muse integration screen tour" and "v1.6.4.x preview code" as source material. The document defining the app narrative treats Eyal's output as canonical.
- Rosie handles airport pickup for Eyal and Mathieu together on the June 18, 2026 logistics email [GM-20260618-1110]. Same category of guest.

Weight: Very high. All artifact-grounded.

## 3b. Demos on the record — the work was shown, and it was named

**Verdict: Across July 16, August 6, and August 13 team calls, Eyal walked George and Allan through running app modules he had built. Both reacted on tape, publicly, in the team's presence, naming the work back to him.**

Grounding:

- **July 16, 2026, 1:1 with George** [`VTC_-George-Eyal-Transcript-3.txt`; `DEMO-MOMENTS.md`]. Eyal shows the sessions timeline, the styles gallery, the empathic-art flow, the documented GitHub handoff for Jacob. George on tape:
  > "I think it's beautiful."
  > "which I think is beautiful, by the way, how you did that."
  > "it came out really nice."
  > "a full-fledged, full-on documented GitHub with everything he needs to integrate, like every comment, it's all beautifully organized."

  And, framing the partnership question after seeing what Eyal built:
  > "how do you think, you know, so how do we work together? What's your thought about the structure? Of this, you've done so much and it's so beautiful."

- **August 6, 2026, Boundless app-development team call** [`VTC_-Boundless-app-development-Transcript-1-13.txt`, blocks 24:05, 28:25, 29:52; `DEMO-MOMENTS.md`]. In front of Bob, Jacob, Allan, and the wider team, Eyal presents two things he built and integrated: a developer-facing Muse wizard (six 45-second chunks with a layman-language log function) and a Muse simulation mode with six emotional-journey presets so the app can be tested without hardware. George on tape:
  > "That's amazing."
  > "Interesting, cool." (on the simulation mode)
  > "we've been working a bit with Phil and Simon in terms of how to think about audience and marketing… they're very locked into really leveraging this concept of entropy. And they think it's really interesting and important. And so I think getting these threads together is really important. So I guess another piece of work for all of us over the between now and next week is to dig into what EILS created."

  "EILS" is the auto-transcription's mishearing of "Eyal." George on the record routes what Eyal built to Boundless's marketing minds (Phil and Simon) as material for the company's brand narrative.

- **August 13, 2026, Boundless app-development team call** [`VTC_-Boundless-app-development-Transcript-2.txt`, blocks 3:51, 33:32, 35:08; `DEMO-MOMENTS.md`]. Allan opens the call by locating Eyal's built screens inside the Boundless user narrative:
  > "We've included screens from ALS, live build, as well as from the app as it currently stands and whatever. And so I think the idea is now just to figure out how all these screens stitch together."

  Later on the same call, George maps the app's own art flow to Eyal's work by name:
  > "if they stay the same, the colors of the image, not the dynamism of the image, stays the same. If it's different, it morphs from one quadrant or one place to another based on Eyal's color palette, based on his research summaries."

  And a sentence later:
  > "this is why we need to have Eyal on a call, but I think I need to prepare him because he's really attached to what he's done."

  Allan on the dropdown / art-styles UI Eyal built:
  > "When I originally, you know, this is going to deliver some app, some art to you, you know, from your aesthetic preferences and your EEG signal, I didn't actually imagine. You literally selecting your art style from a dropdown menu. And I think that's an interesting thing to see how various styles kind of interpret the same data."

What these three calls establish, in four weeks, on tape, in front of the team:

1. Eyal was not previewing sketches. He was showing running, integrated app modules: wizard, simulation mode, shader rendering, sessions timeline, styles gallery, color palette, research summaries, GitHub handoff.
2. George and Allan named the work back to him publicly, using authorship language: "how you did that," "what EILS created," "Eyal's color palette, based on his research summaries," "he's really attached to what he's done."
3. George on the record routed Eyal's entropy work directly to Boundless's marketing minds (Phil and Simon) as material the company would leverage in its audience and marketing frame.

The August 20 pivot to "Laura and the team are working on that" has to be read against these three calls. The record does not support a framing in which Laura and the internal team were the source of the visual and emotional-art work; the record supports the opposite.

Full quotes with speaker attribution and line-block anchors are in `DEMO-MOMENTS.md` (same folder).

Weight: Very high. All artifact-grounded (three separate Zoom transcripts, quoted verbatim, with speaker labels reconciled against transcriber mishearings).

## 4. Inspiration Boundless drew from Eyal

**Verdict: Boundless's own words on the record say Eyal's work is the asset the company wants to own.**

Grounding:
- **The July 16, 2026 call is the single most explicit acknowledgment of authorship on record.** George at 14:32:

  > And so, look, I think that if we're going to create value inside of Boundless, this will need to be an asset owned by Boundless. So, that would lead to there is a there, there's IP. There's IP on that, there's copyright on the music, there's IP on the chaos engine. So we'd have things that become an investable entity. Otherwise, it's a nice art project, right?

  George is not saying Boundless drew inspiration. He is saying the work has to become a Boundless-owned asset or the company has "a nice art project." That framing only makes sense if the IP is Eyal's to transfer. [TRANSCRIPT-20260716-george-asset-owned-by-boundless]
- The Aug 12 User Narrative v1.8 explicitly names Eyal's 19-page screen tour and preview code as its source [DOC:DRAFT-Boundless-App-User-Narrative-v1.8.docx].
- Bob's Nov 4, 2025 technical reply builds directly on Eyal's four foundation documents including the Empathic Art manifesto and VERA framework [GM-20251102 → GM-20251112].
- George's Sept 17, 2025 mandate names "the empathic technology platform" as what he wants to integrate. That platform is Eyal's. [GM-20250917-0734]
- The Aug 6, 2026 recorded call: George at 33:32 acknowledges "he's really attached to what he's done." The verb "done" concedes authorship. [EG:transcript]
- Factual caveat on the Otter recap: at the June 26, 2026 Ibiza foundation meeting, Otter's speaker-labels assigned Eyal's speech to George. The auto-generated recap therefore attributes Eyal's own biography and his Forces / Atmospheres / States trilogy to George Goldsmith. Anyone reading the recap without the raw audio would conclude George is the author of Eyal's decade of work. - Testimony: Sian's Aug 18, 2026 staging release describes the creative as "based on my previous works" and the About page lists 9 people, the band lists 17, and Eyal is on neither [EG:website-observation; GM-20260818]. This is important as a divergence signal, not as evidence of inspiration. It says Boundless was inspired enough to build on the work but is currently hedging on public attribution.

Weight: Very high on inspiration. George's July 16 words are direct; the divergence signal is medium (testimony plus site observation).

## 5. Eyal's commitment to Boundless

**Verdict: Sustained, escalating, and financially one-sided in Boundless's favor.**

Grounding:
- Two Ibiza trips paid by Eyal, never invoiced [EG:own-dime]. Both confirmed by calendar and email but the "own dime" framing is testimony.
- **Ibiza-week product ownership on the record.** June 23-29, 2026 Perplexity Computer session "Boundless Ibiza Collaboration Planning" (50 turns, 15 associated content files, all archived): Eyal directed the entire Boundless app v1 build in real time — art direction, UX flow, WebGL fluid-dynamics engine, Muse EEG integration architecture, IndexedDB persistence schemas, iPhone/iPad/Mac responsive design, live team-demo deployments — during the days leading into and through the Ibiza working weekend. Turn 12: "my presentation is in 30 minutes." Turn 47: "deploy it so I could demonstrate it from another Mac to the team in 10 minutes." Turn 36: "this will be used for the final Boundless app." Sole product owner on every turn. This upgrades "full-time on Boundless" from testimony to artifact for the June 2026 window. - Testimony: full-time on Boundless since the FORCES London opening at the start of May 2026 [EG:full-time-since-May]. The calendar cadence (near-weekly VTCs, plus Ibiza 2, plus the July and Aug dev calls) is consistent with this testimony. For the June 23-29 window specifically, the Ibiza planning session provides direct artifact evidence.
- Delivery pace in August 2026 alone: Aug 12 sends the 19-page screen tour; Aug 15 delivers the "Empathic Art Decisions" PDF from the Aug 13 call recording; Aug 16 sends the full integration package to Jacob on his first day in Venice with George, Allan, Bob on CC and pushes to the empathic-art repo the same day. Three deliverables in five days, from Venice, during the Biennale.
- July 30, 2026 proposal cover: "Looking forward to hearing from you soon, so we can get everything ready and launch on October 10 together" [GM-20260730-1126]. Eyal is speaking about the launch as a shared goal.
- Aug 7, 2026 counter [GM-20260807-1540, DOC:2026-08-07-Gmail-Proposal-as-sent.pdf]: Eyal reduced his retainer from €12K to €10K, reduced equity from 3.0% to 1.0%, sized the €500K App engine buyout (€310K baseline + €190K ownership premium), and deferred Live/Sanctuary pricing to a trigger event. The as-sent Gmail print is on file at `evidence/proposals-as-sent/2026-08-07-gmail-proposal-art-creative-director-as-sent.pdf`. Its page 3, "Where I think this lands," enumerates every structural concession made from George's Aug 6 memo: buyout mechanism, equity reduction, retainer reduction, licence-fee stacking removed, minimum guarantee removed, monthly licence fee removed, improvement grant-back removed, Live and Sanctuary deferred to trigger. That is documented unilateral movement toward Boundless, without reciprocity.
- Aug 19, 2026 "Where are we" [GM-20260819-2038]: "Boundless is my top priority."

Weight: Very high. Delivery pace, Aug 7 concessions, and the Ibiza-week product-ownership session are fully documented; the May-onward full-time framing is testimony consistent with the record.

## 6. Attention Eyal spent on Boundless

**Verdict: Disproportionate. Boundless received the bulk of Eyal's professional attention in 2026.**

Grounding:
- Only one missed call across ~52 events, Aug 13, and Eyal reconstructed the call from the recording, produced a PDF, and sent it back within 48 hours [DOC:Boundless-Empathic-Art-Decisions.pdf]. That is compensating for a missed touch, not reducing engagement.
- Aug 16, 2026: Eyal chose his first day in Venice for the Biennale to send the full integration package to Jacob with the founders on CC [GM-20260816]. He worked through what was supposed to be a scheduled cultural break.
- Aug 20, 2026, 23:27 IDT: Eyal's long structured reply to George's pause message ran late into the night after a full working day, closing with "I wish I wasn't. But I am very worried. And you need to know that" [WA-20260820-2327 · very-worried]. Personal boundary crossed in Boundless's direction, at Boundless-set cadence.
- Testimony: full-time since May 2026 [EG:full-time-since-May], now on the record in Eyal's Aug 20 WhatsApp reply and uncontested by George in the eight days of silence that follow.

Weight: High. Delivery-attention points are documented; the full-time claim is testimony.

## 7. Involvement Eyal has in the product

**Verdict: Author-level involvement in the app's visual and conceptual layer.**

Grounding:
- **The post-Ibiza dev alignment (Allan's Notion doc, late June 2026) names Eyal as the owner of three workstreams: art generation (next-gen engine), site art, and UX design sign-off (final creative approval). The operating model is spelled out: "Eyal sets the creative direction, the team produces against it, Eyal gives design points, the team iterates until he signs off." Next steps include "Lock the Eyal → produce → review → sign-off loop for UX."** [DOC:notion-agendas/post-ibiza-dev-alignment.md]. This is Allan describing Eyal to the founder team in the language of a Creative Director, not a vendor.
- The Aug 6 Notion agenda names Eyal as co-owner alongside Bob and Jacob on three of the six art-and-experience decisions, cross-references the user narrative against "Eyal's Empathic Art v1.6.4 preview code," and books "Allan to expand on how Eyal's art engine fits into the user narrative" as a next step [DOC:notion-agendas/aug6-dev-call-agenda.md].
- The Aug 27 Notion agenda states the goal as "close the art-generation decisions with Eyal" and lists art-generation confirmations that map 1:1 to the WebGL fluid engine, circumplex mapping, and no-EEG simulator Eyal built in the June Ibiza planning session [DOC:notion-agendas/aug27-dev-call-agenda.md, SESSION:31837ae7].
- The 19-page Muse integration screen tour and the v1.6.4.x preview code are cited as source material by the official user narrative [DOC:DRAFT-Boundless-App-User-Narrative-v1.8.docx].
- Empathic Art manifesto, VERA framework, and Conceptual Groundwork documents are the substrate of the "Emotional AI Due Diligence" thread with Bob [GM-20251102 → GM-20251112].
- Eyal co-led two of the eight Ibiza 2 working sessions [GM-20260612-1505].
- Fourteen open Q&As sent to Jacob on Aug 16 as part of the integration package [GM-20260816]. Vendors do not send open Q&A lists to engineering; authors do.
- Repo control: `ARTWORK-LICENSE.md` reserves all rights on visual art, brand identity, and generated outputs. The MIT LICENSE covers code only. Eyal is sole admin on `empathic-art` with Bob and Jacob as push collaborators [REPO:empathic-art].
- **Repo forensics on the same repo, run Aug 28, 2026 from git metadata: 117 of 118 commits by Eyal (99.2%), +44,637 / -4,172 lines across 172 files. Every one of the top 30 files by size is Eyal-authored. All 16 visual worlds Eyal. All 7 GLSL shaders Eyal. The fluid engine Eyal. Bob has 1 commit (~900 net lines of Muse BLE plumbing). Jacob has zero commits.** The delivery window is 39 days (July 9 to Aug 16, 2026) for ~41,866 net new lines. That is the output profile of a dedicated senior full-stack engineer directing a 6-8 week sprint, done by one person while also running the art direction and holding the vision. - **Allan on Jan 13, 2026, on the record with George and Bob present, calling Eyal "in some ways the paintbrush" of the empathic-art concept:**

Weight: Very high. All artifact-grounded. The post-Ibiza dev alignment is the ceiling document at the operating-model level; the repo forensics is the ceiling document at the code level. Both were written by Boundless (Allan for the operating model, git for the code) and both put Eyal at author level.

## 8. Seriousness with which Boundless treated Eyal

**Verdict: Serious enough to give him founder-tier access and cadence; not serious enough (yet) to close on paper.**

Grounding of the "serious" side:
- Founders' EA managing his schedule for 11 months [GM sweep, Rosie signature evidence].
- Two Ibiza trips at George's private house.
- Sept 17, 2025 written mandate in George's own words [GM-20250917-0734].
- Weekly Thursday VTC standing invite for eight months.
- Full Claude strategic memo shared as an attachment [GM-20260806-0007, DOC:Investor-Implications-of-Eyal-s-proposal.docx].
- Allan's app narrative building explicitly on Eyal's documents [DOC:DRAFT-Boundless-App-User-Narrative-v1.8.docx].
- **Post-Ibiza dev alignment (Allan, June 2026) names three Eyal-owned workstreams and gives him "UX design sign-off (final creative approval)" as a written role assignment to the founder team** [DOC:notion-agendas/post-ibiza-dev-alignment.md]. This is the internal, unfiltered version of how Boundless describes his role.

Grounding of the "not yet closed on paper" side:
- No engagement letter, no compensation contract on file for the entire runway from Sept 2025 through Aug 2026.
- Two Ibiza trips not reimbursed [EG:own-dime, consistent with the absence of any invoicing artifact in the record].
- Six days of proposal opens with no reply July 30 → Aug 5 [Mailtrack signals].
- The Aug 6 "unfundable" reply comes 8 days after delivery, with a Claude memo attached [GM-20260806-0007].
- Aug 8 "we will respond early next week" [GM-20260808-0109] followed by twelve days of silence on the counter.
- **Aug 13, 2026, 08:17 LA: George in writing on WhatsApp: "I will send a response to your revised proposal on Friday"** [WA-20260813-0817 · friday-promise]. Then Aug 14, 08:07 LA, shifted to "aiming for Sunday or Monday." Then Aug 20, 00:17 LA, shifted to "take a pause for now." The Friday commitment is a written Boundless promise that broke.
- **July 30, 2026, 20:15 LA: George in writing on WhatsApp calling the very proposal he later called "unfundable" a "super thoughtful document today"** [WA-20260730-2015 · super-thoughtful]. The exact document is on file: the 10-page as-sent proposal PDF [DOC:2026-07-30-Boundless-Proposal-to-George.pdf] at `evidence/proposals-as-sent/2026-07-30-boundless-proposal-to-george-original.pdf`, prepared for George Goldsmith, marked confidential, July 2026. Same document, three verdicts, seven weeks: "super thoughtful" on WhatsApp Jul 30 at 20:15 LA; "unfundable" in the Aug 6 memo `[GM-20260806-0007]`; and reframed on Aug 20 21:16 LA as being like Bob and Jacob's equity-only arrangement `[WA-20260820-2116 · bob-and-jacob-doing-it-for-equity]`. No substantive intervention from Eyal between the first two. Same evening at 21:15 LA George put the frame for the whole negotiation on the record in writing: "The key issue we need to each consider is how to create an investable entity as the use of licenced IP can be a challenges . So let's out on our thinking caps 🤔 I am excited by the long term possibilities here and welcome real engagement together!" [WA-20260730-2115 · investable-entity]. This is the frame Eyal wrote the proposal into. The Aug 6 "unfundable" reply and the Aug 20 reversal to equity-only are inside that same frame George set in writing.
- **June 9, 2026, 18:56 LA: George in writing on WhatsApp before Ibiza 2: "I assume we will cover all expenses and talk about other terms as soon as we find time together"** [WA-20260609-1856 · cover-all-expenses]. This is the written Boundless commitment to cover Ibiza 2. The reimbursement never happened. Both Ibiza trips (Oct 2025, Jun 2026) were on Eyal's own money. What was previously framed as "own dime" is now a broken written commitment, not a silent absorption of costs.
- Aug 18 staging site ships without Eyal on the About page (9 named team members) or the band (17 named musicians), with "your personal art (coming soon)" and no artist attribution in the FAQ. Content confirmed against the framer.app source, a PDF snapshot, and a full-page Aug 28 screenshot from Sian, all in the workspace archive [DOC:About-Boundless-Studios.pdf, IMG:framer-site/about-page-full-screenshot-2026-08-28.jpg, URL:right-goblin-619418.framer.app/about].
- **The public About page names Dominic Miller as "Creative Director" with a dedicated portrait section, parallel to George Goldsmith's "founder" section.** Per Eyal's testimony, Boundless positioned this to him privately as a music/visual split — "Dominic is the music guy, I'm the art guy" — with Dominic as music creative director and Eyal as visual/art creative director. That framing is consistent with the site's content structure (Dominic sits above the band roster, not above the app material) but is not carried by the public title, which is the unqualified "Creative Director." Allan's post-Ibiza Notion dev-alignment doc (June 2026) meanwhile assigns Eyal "UX design sign-off (final creative approval)" and the operating model "Eyal sets the creative direction, the team produces against it, Eyal gives design points, the team iterates until he signs off" [DOC:notion-agendas/post-ibiza-dev-alignment.md, EG:dominic-music-not-visual]. All three statements can be simultaneously true only if the public site copy is updated before Oct 10 to disambiguate Dominic's music domain from Eyal's visual/UX domain. As of Aug 28 the public page does not carry that qualifier.
- Between Aug 18 and Aug 28, someone with owner access to the Framer project switched on server-side staging-site authentication. As of Aug 28 at 11:51 AM UTC the same URL redirects to `framer.com/login?origin=protected-staging`, meaning no one outside Framer can independently verify what the page says today. The Aug 28 screenshot from Sian is the only current public record.
- Aug 26 Allan announces new @boundless.health email address mid-negotiation [GM-20260826-1712].
- Aug 27 VTC "Boundless app development" happens with the CC-chain visible in Eyal's inbox not showing him on the invite [GM-20260827-0211].
- **Aug 13, 2026: with Eyal on a boat in Mallorca and out of the call, George holds the art-scope conversation without him and then plans to relay the outcome after the fact.** George at 24:40: "Could we have a conversation about that for a couple minutes, Allan, without AL and then use that way to inform AL? I'm talking to him tomorrow, it appears." [TRANSCRIPT-20260813-george-conversation-without-al-then-inform-al] George at 40:10: "Decision taken. My job is to communicate it." [TRANSCRIPT-20260813-george-decision-taken-my-job-to-communicate] The person named as owner of three workstreams in Allan's own June dev-alignment doc is not in the room for the scope decision on those same workstreams.
- **Jan 27, 2026: a meeting is held without Eyal in which Muse is selected as the data source and George says "I think we'll wait for et al to emerge a little bit and work with him"** [TRANSCRIPT-20260127-george-wait-for-et-al-to-emerge].
